(law) A test of criminal insanity by which "it must be clearly proved that, at the time of committing the act, the party accused was labouring under such a defect of reason, from disease of the mind, as not to know the nature and quality of the act he was doing, or, if he did know it, that he did not know he was doing what was wrong".

The defense argued that, under the McNaughton rules, his actions could not be attributed to criminal intent because a mental disease had impaired his ability to know the nature and quality of the act or to know that it was wrong.

弁護側は、行為時に被告が心の病に起因する理性の欠如のために行為の性質や内容を理解していなかった、あるいはそれを悪いと認識していなかったことが明白に証明されることを要する刑事責任能力の判定基準の下では、彼の行為は故意に帰せられないと主張した。
