３ 商業用レコードの公衆への貸与を営業として行う者（以下「貸レコード業者」という。）は、期間経過商業用レコードの貸与により実演を公衆に提供した場合には、当該実演（著作隣接権の存続期間内のものに限る。）に係る実演家に相当な額の報酬を支払わなければならない。
